Appeals for Asylum and Immigration Applications

If your asylum or immigration application is refused, you may have the right to appeal or challenge the decision. The appeal process applies to various immigration and visa applications, including asylum claims, and allows you to contest the Home Office’s decision.

Appeal Process and Timeline

  1. Lodge Appeal – You must submit your appeal within 14 days of receiving the refusal notice for asylum cases. For other visa or immigration refusals, you typically have 28 days if you’re outside the UK and 14 days if you’re inside the UK.
  2. Prepare Grounds for Appeal – Work with your legal representative to present new evidence or argue legal, factual, or procedural errors in the Home Office’s decision (1-2 weeks).
  3. Instructing Counsel – Your lawyer will recommend a barrister to present your case in court.
  4. Hearing Scheduled – A hearing will be set before the First-tier Tribunal, usually within 6-12 months, where your barrister can present your case and cross-examine witnesses.
  5. Tribunal Decision – If successful, the decision may be overturned, granting you refugee status or other forms of leave to remain. If unsuccessful, you may appeal further to the Upper Tribunal or apply for judicial review.

Appeals are highly nuanced and depend heavily on the specific details of your case and the reasons for refusal. Please contact our team for further information and personalised advice tailored to your situation.
