Victims of Human Trafficking and Modern Slavery

In the course of our work as immigration and asylum lawyers we’ve seen first hand how the crimes of human trafficking and modern slavery have proliferated in recent years. The perpetrators of these crimes are the concern of the police and judicial authorities. How Can The Law Help Me If I Am A Victim Of Trafficking Or Modern Day Slavery?

Exploitation can take many different forms. A trafficked person with immigration issues will need specialist legal advice, representation and support throughout the trafficking and immigration application processes.

The Met Police describes Modern Day Slavery as ‘the illegal exploitation of people for personal or commercial gain’. It can cover a range of abusive and exploitative behaviour, including sexual exploitation, domestic servitude, forced labour, and human trafficking.

The authorities in the UK have a clear legal obligation to protect victims. That’s because the UK has signed up to the Council of Europe Convention on Action against Trafficking in Human Beings. The National Referral Mechanism (the NRM) is required to identify and support potential victims.

How Do We Help Trafficking And Slavery Victims?

Trafficking cases are usually factually complex. And decision-making isn’t always as legally robust as it should be.

If you have been trafficked there are a number of ways that the law can help you. You may want to remain in the UK for either the short or long term, report violence you have experienced to the police or seek compensation for injuries you have received.

We have experience of helping our clients through these processes and can substantially improve the trafficked person’s prospects of success, both in respect of their trafficking decisions and their immigration applications. We are committed to working sensitively and fearlessly to help you enforce your legal rights.

At Milestone our role is to ensure our clients get the support they are entitled to. When victims don’t get the state support they need, we step in to build a case and protect you. This involves:

  • Pursuing immigration claims on behalf of individuals
  • Safeguarding your right to remain in the UK where possible
  • Making judicial review applications when a public authority rules against a client
  • Challenging a decision not to refer clients to the NRM
  • Securing the release of victims unlawfully detained under immigration procedures
  • Applying for indefinite leave to remain in the UK
  • Applying for asylum in the UK in appropriate cases

Milestone also assists victims of domestic violence whose immigration status is uncertain or whose leave to remain is unconfirmed.
